$750,000 Settlement

$750,000 Settlement

Type of Action: Negligence and tort

Verdict or Settlement: Settlement

Injuries Alleged: right lower extremity crush injury with vascular and nerve damage

Name of Case: withheld

Court: withheld

Case No.: withheld

Tried Before: N/A

Date Resolved: 4/01/2025

Special Damages: $95,717

Amount: $750,000

Attorney(s) for plaintiff: Whit Long, Howard Bullock, and William Kilduff, Richmond

Paralegal: Anna Martin

Description of case: The plaintiff was unloading the trunk of her vehicle, when she was unexpectedly struck from behind by a commercial transport shuttle and pinned between the bumper of her vehicle and the shuttle. The driver of the shuttle had exited the vehicle without putting it in park and, after realizing the mistake, attempted to jump back in and apply the brake but hit the accelerator instead.

As a result of this incident, the plaintiff was admitted to the hospital for three days and sustained serious injuries, including a right lower extremity crush injury with significant vascular insult and nerve damage.

The plaintiff underwent extensive orthopedic and neurology treatment but continues to suffer from pain, numbness, and weakness in her right leg, and her treating providers were prepared to testify to permanency, despite a normal EMG. While the permanency of plaintiff's injuries was vigorously contested, the parties were able to resolve the case shortly before trial.

From beginning to end it was great knowledge of resources, teamwork and patience from E & K that built an indisputable case. Their knowledge and hard work while constantly preparing for trial lead to the insurance company realizing they had no recourse. Skilled negotiation lead to an acceptable settlement following my car accident with disputed liability. Highly recommended!
