Description of case: The plaintiff was unloading the trunk of her vehicle, when she was unexpectedly struck from behind by a commercial transport shuttle and pinned between the bumper of her vehicle and the shuttle. The driver of the shuttle had exited the vehicle without putting it in park and, after realizing the mistake, attempted to jump back in and apply the brake but hit the accelerator instead.
As a result of this incident, the plaintiff was admitted to the hospital for three days and sustained serious injuries, including a right lower extremity crush injury with significant vascular insult and nerve damage.
The plaintiff underwent extensive orthopedic and neurology treatment but continues to suffer from pain, numbness, and weakness in her right leg, and her treating providers were prepared to testify to permanency, despite a normal EMG. While the permanency of plaintiff's injuries was vigorously contested, the parties were able to resolve the case shortly before trial.
