Summary: The plaintiff was traveling northbound on River Road in Chesterfield County. As he approached a four-way intersection with stop signs controlling traffic moving east and west, the defendant, who was driving a box truck owned by his employer, disregarded the stop sign and collided with the plaintiff. Upon impact, the tires of the truck rolled over the hood of plaintiff's car, before flipping onto its side, while plaintiff came to a stop in an adjacent yard.
As a result of the crash, the plaintiff sustained an AC joint sprain, ulnar neuritis, and a partial tear of the superior labrum. He underwent physical therapy and other medical treatment but continues to suffer ongoing pain, numbness, and discomfort in his left elbow and shoulder and will ultimately require future surgical treatment to address his elbow and shoulder injuries.
While the defense vigorously contested the plaintiff's need for future surgical treatment, the parties were able to resolve the case shortly before trial.
